A New York woman has been ordered by a Judge to not get pregnant. At least until she has been found to be a fit mother of her infant son.
The Internet is raging. But let’s break down all the details.
Family Court Judge Patricia Gallaher said that this judgment is intended to give the woman, a drug addicted prostitute, a chance at a rehabilitated life. The woman has other children but they have all been taken in by other people.
According to wsvn.com, the Judge stated, “Society and its problems are changing, especially with the incredible rise in the use of heroin, and this court needs to adjust in response instead of doing the same tired routine which does not solve the obvious problems in so many cases,” the Rochester judge wrote in the December order.
Now, further down the rabbit hole we go….the woman admitted to using crack, methadone and drinking alcohol while pregnant with her infant son. She’s also, as stated earlier, a prostitute.
Now things get tricky…The New York City Civil Liberties Union wants to offer assistance in an appeal for the woman. Fordham University sociology professor Jeanne Flavin called the order a “violation of human rights.”
“If the courts and our child welfare systems were truly committed to the health and well-being of families, they would ensure people have the supports they need in order to feed, shelter, educate and care for their children in safe environments,” said Flavin, who is on the board of directors of the National Advocates for Pregnant Women, a reproductive justice organization.
The Internet is, as you’d expect, a divided monster.
I love reading the comments section. Such wisdom, such ethically inclined commentary. Everyone thinks she should be spayed like a dog… not one person has suggested rehabilitation. Lovely.
I would love to hug this judge! This woman choses to have sex for money in order to feed her drug addiction. She obviously can not control her addiction for the health of the babies she creates. Sadly nothing will happen if she does get pregnant again because the judge promised not jail her if she does but it is a step in the right direction for cases like this. I say make the Depo shot mandatory for woman like her.
Too much Government can be a bad thing, I think we can all agree. But is there a line? We’d remove children from abusive homes, would we not attempt to make sure babies aren’t exposed to abuses even as fetuses? Or is this government overreaching and dictating what a woman can do with her body? The issue is complex, no doubt, and I expect debates shall rage on in mommy land…One thing we might note is that it seems as if the Judge made a fruitless order. It seems it says she wouldn’t enforce any punishment?
